These legal TERMS OF USE (English Law applies) are between you and Next Move Games & Leisure Ltd trading as Game Guru (Game Guru, us, we, the Service, The Agreement), and you agree to them by creating an account and using the Service.

You should read this document along with our Privacy Policy.

1. Acceptance of the Terms of Use Agreement

By creating a Game Guru account or by using the Game Guru app and website (www.gameguru.co.uk) whether on a mobile device, mobile application or computer (collectively, the "Service") you agree to be bound by (i) these terms of use, (ii) our Privacy Policy, each of which is referenced in this Agreement, and (iii) any and all terms disclosed and agreed to by you if you use or purchase additional features, products or services Game Guru offers from time to time on the Service (collectively, this "Agreement").

If you do not accept the terms and agree to be bound by all of the terms of this Agreement, you may not and will not use this Service. Changes to this Agreement can and will be made over time. Reasons for doing so include changes in law and legislation, new features, or changes in business practices. The most recent version of this Agreement will be available to view on our website and upon signing up to the app. You should regularly check for the most recent version. The most recent version is the version that applies. If the changes include material changes that affect your rights or obligations, we will notify you in advance of these changes by reasonable means, which could include notifications through the "Services" or via email, with the email you provide in your account. If you continue using "Services" provided by Game Guru after the changes become effective, then you agree to the revised Agreement.

2. Eligibility

You must be at least 18 years of age to create an account on Game Guru and use the Service. By creating an account and using the Service, you agree that:

  • You form a binding contract with Game Guru
  • A User account becomes active when your details are entered into the database
  • A paid Subscription Membership becomes effective when payment has been processed
  • Only one account per person is permitted
  • Staff Members may hold personal accounts but are not permitted to use their subscription benefits, loyalty points, or discounts on transactions they process or earn points from transactions they process while on duty
  • Game Guru may refuse any application for an account or Subscription Membership, or terminate any account or Subscription Membership, without notice or reason
  • You are not a person that is barred from using the Service under the laws of the United Kingdom or any other applicable jurisdiction from any nation worldwide. You do not appear on any government sanctions list or face any other similar prohibition
  • You will comply with this Agreement and all applicable local, state, national and international law, rules and regulations
  • You have never been convicted of a felony and that you are not required to register as a sex offender with any state, federal or local sex offender registry in any nation
  • If you are unable to read or understand these terms you have been made aware of all terms of this Agreement by someone who is able to do so

3. Your Account

In order to use Game Guru, you may sign in using your mobile number/email address. We do not share any information without your consent. For more information about the information we collect from you and how we use it, please visit our Privacy Policy. You are entirely responsible for maintaining the privacy of your login credentials you use to sign up for Game Guru, and are solely responsible for all activities that occur under those credentials. If you believe someone has gained access to your account, please contact us immediately.

5loyalty LTD (reg. 10020833) acts as a data processor for Game Guru in relation to the loyalty program and app functionality.

4. Game Guru Website

The Game Guru website may contain some features of the app as well as this Agreement and the terms of our Service. Please refer to www.gameguru.co.uk if you are unaware of the terms and conditions outlined in this Agreement. All actions performed on www.gameguru.co.uk must comply with criteria outlined in this Agreement.

5. Subscription Membership Terms

5.1 General Subscription Membership Terms

Personal & Non-Transferable
All Subscription Memberships are registered to the named individual and cannot be transferred, sold, or gifted to another person. Golden Ticket memberships are numbered and registered to the named individual. You may not sell, gift, or transfer your Subscription Membership to another person.

Proof of Subscription Membership
Subscription Members must present their membership via the Game Guru app when visiting to receive subscription benefits. Staff members may hold Subscription Memberships but cannot use benefits on transactions they process or while on duty.

One Subscription Membership Per Person
Each person may hold only one active Subscription Membership at a time.

5.2 Subscription Membership Tiers

Game Guru offers three Subscription Membership tiers:

  • Casual Player - Monthly subscription
  • Core Gamer - Monthly subscription
  • Golden Ticket - Annual subscription

Each Subscription Membership tier provides specific benefits as outlined in the app and on our website.

5.3 Subscription Membership Benefits

5.3.1 Table Play Access

  • Casual Player: Unlimited play Monday–Friday only (up to 4 hours per day)
  • Core Gamer: Unlimited play 7 days a week (up to 4 hours per day)
  • Golden Ticket: Unlimited play 7 days a week (up to 4 hours per day)

All Subscription Memberships include up to 4 hours of table play per day, on the days specified by your subscription tier. Additional hours beyond the 4-hour daily limit will be subject to the standard day pass rate person, per hour.

5.3.2 Discounts

  • Subscription Member discounts apply to food, drinks, and retail purchases as specified in each tier
  • Discounts cannot be combined with other promotional offers, special deals, or vouchers unless explicitly stated
  • Discounts apply to the Subscription Member's personal consumption. If the Subscription Member is paying the entire bill, the discount applies to the full amount. If bills are split, the discount applies only to the Subscription Member's portion

5.3.3 Guest Pass (Golden Ticket Only)

Golden Ticket members receive a +1 Guest Pass allowing them to bring one guest per visit at no additional charge for table play.

  • The Guest Pass is only valid when accompanying the Golden Ticket member
  • The Golden Ticket member must be present for the guest to receive free entry
  • Cannot be used independently by the guest
  • Does not entitle the guest to Subscription Member discounts on food, drinks, or retail
  • Subject to venue capacity; Game Guru reserves the right to limit Guest Pass usage during peak times or special events

5.3.4 Priority Event Booking

Subscription Members receive emails/notifications for priority access to book tournaments, game launches, and special events before non-members.

5.4 Payment & Renewal

5.4.1 Monthly Subscriptions (Casual Player & Core Gamer)

  • Automatically renew each month unless cancelled by the Subscription Member
  • Billed monthly on the anniversary of sign-up date
  • Payment processed through the payment method provided in your account

5.4.2 Annual Subscription (Golden Ticket)

  • Valid for 12 months from the date of purchase
  • Automatically renews annually unless cancelled by the Subscription Member
  • Payment processed through the payment method provided in your account

5.4.3 Payment Authorization

By subscribing, you authorize Game Guru to charge your payment method for all fees due.

5.4.4 Payment Failures

If your payment method fails or is declined, your Subscription Membership may be suspended or terminated.

5.5 Cancellation & Refunds

Monthly Subscriptions (Casual Player & Core Gamer)
Can be cancelled at any time. Cancellation will take effect at the end of the current billing period. No refunds will be provided for partial months.

Annual Subscription (Golden Ticket)
Non-refundable once purchased. Cancellation will prevent automatic renewal but the Subscription Membership remains active until the end of the 12-month period.

How to Cancel
To cancel your Subscription Membership, please do so through your account settings in the app or contact customer service at hello@gameguru.co.uk.

5.6 Suspension & Termination

Game Guru reserves the right to suspend or terminate any Subscription Membership immediately without refund if:

  • The Subscription Member violates our Terms & Conditions
  • The Subscription Member engages in disruptive, abusive, or inappropriate behaviour at the venue or on the Service
  • The Subscription Member's payment method fails or is declined
  • Game Guru determines the Subscription Membership is being misused

Upon termination, all Subscription Membership benefits cease immediately and any unused benefits are forfeited.

5.7 Changes to Subscription Membership Terms

Game Guru reserves the right to modify Subscription Membership benefits, pricing, and terms at its sole discretion.

If these amendments affect your rights or obligations, we will provide notifications in advance of these changes by reasonable means, which could include notifications through the app or via email.

5.8 Venue Access & Limitations

Subscription Membership does not guarantee:

  • Table availability at specific times
  • Access during private events or venue closures
  • Entry if the venue is at capacity

Subscription Members must comply with all venue rules and policies.

6. In-App Ordering and Payments

6.1 Food and Beverage Orders

Users (both Subscription Members and non-members) may order food and beverages through the app for collection or table service at the Game Guru venue. By placing an order, you agree to pay all charges associated with your order including applicable taxes and service charges.

6.2 Order Accuracy

You are responsible for ensuring your order is correct before submitting. While we will make reasonable efforts to accommodate changes or cancellations, once an order is confirmed and preparation has begun, it may not be possible to modify or cancel.

6.3 Allergies and Dietary Requirements

It is your responsibility to inform staff of any allergies or dietary requirements. While we take care to accommodate dietary needs, we cannot guarantee that our food is free from allergens due to the nature of our kitchen environment.

6.4 Age-Restricted Products

Alcoholic beverages may only be ordered and consumed by persons aged 18 or over. Game Guru reserves the right to request proof of age and refuse service to any person who cannot provide valid identification or who appears intoxicated.

7. Loyalty Rewards Program

The Loyalty Rewards Program is available to all Users (both Subscription Members and non-members with accounts).

7.1 Earning Points

Users earn loyalty points on eligible purchases made through the app or at the venue. The rate at which points are earned and which purchases are eligible may vary and is at Game Guru's sole discretion.

7.2 Redeeming Points

Points may be redeemed for rewards as specified in the app. Game Guru reserves the right to modify the rewards catalogue and redemption values at any time.

7.3 Points Expiry

Loyalty points may expire if your account is inactive for a specified period, or upon termination of your account. Game Guru will provide reasonable notice of any points expiry policy.

7.4 Points Restrictions

  • Points have no cash value and cannot be exchanged for cash
  • Points cannot be transferred between accounts
  • Points earned through fraudulent activity will be forfeited
  • Game Guru may adjust point balances if errors are identified

8. Table Booking and Venue Access

8.1 Table Availability

Table booking is subject to availability. Subscription Members with active subscriptions may receive priority booking for tables and events. Game Guru does not guarantee table availability at any specific time.

8.2 Venue Rules

All visitors to Game Guru must:

  • Treat staff, other customers, and venue property with respect
  • Follow all venue safety and hygiene rules
  • Not bring outside food or beverages without prior permission
  • Supervise any children in their party at all times
  • Handle games and equipment with care

8.3 Right of Admission

Game Guru reserves the right to refuse entry or ask any person to leave the venue if they:

  • Are behaving in a disruptive, threatening, or inappropriate manner
  • Appear intoxicated or under the influence of drugs
  • Are in breach of these Terms & Conditions
  • Pose a risk to the safety or comfort of staff or other customers

9. Modifying the Services and Termination

Game Guru will frequently release new features and Services to bring additional functionality. As a result we may add enhancements as well as remove functions and features to align with our overall product strategy. Benefits, Points, and Rewards may be earned on a varying basis and the User accepts that it is in Game Guru's sole discretion as to the basis that Benefits, Points, and Rewards are earned and that not all Users will necessarily receive Benefits, Points or Rewards on an equal basis. Game Guru may adjust the Benefits, Points, and Rewards offered to different classes of Subscription Membership at its sole discretion. If these amendments affect your rights or obligations we will provide Users with notifications in advance of these changes by reasonable means, which could include notifications through the "Services" or via email. If you continue using "Services" provided by Game Guru after the changes become effective, then you agree to the revised Agreement.

You may terminate or delete your account at any time, for any reason, by contacting customer service or through your account settings in the app. Game Guru may terminate or delete your account at any time without notice if we believe you have violated this Agreement. Upon such termination:

  • You will not be entitled to a refund on any Subscription Membership payments, in-app purchases, or unused loyalty points
  • Any active Subscription Membership will be cancelled immediately
  • You will lose access to all Subscription Member benefits and accumulated loyalty points
  • Accounts that are terminated for violations cannot be reinstated

10. Promotional Offers

Game Guru may make Promotional Offers to individual Users or groups of Users and to the exclusion of other Users. Promotional Offers may include Benefits, Points, and Rewards subject to terms and conditions of the Promotional Offers. Game Guru excludes and limits liability in relation to Promotional Offers pursuant to the terms of Clause 18.

11. Safety and User Conduct

11.1 Your Interaction with Other Users

Game Guru encourages a respectful use of its features and respect given to other Users on the platform and at the venue. Users are solely responsible for their actions on and off the Service provided by Game Guru. You agree to use caution in all interactions with other Users, particularly if you decide to communicate off the Service or meet in person. You are solely responsible for your interactions with other Users. Game Guru reserves the right to terminate accounts or ban individuals from the venue for misconduct.

11.2 Prohibited Conduct

Users must not:

  • Use the Service for any illegal activity or activity prohibited by this Agreement
  • Harass, intimidate, threaten, or abuse any person at the venue or through the Service
  • Damage or misuse venue property, games, or equipment
  • Engage in theft or fraudulent activity
  • Share false or misleading information
  • Attempt to gain unauthorised access to other accounts or venue systems

12. Rights Game Guru Grants You and End User License Agreement ("EULA")

Game Guru provides you with a personal, worldwide, royalty-free, non-assignable, nonexclusive, revocable, and non-sub-licensable license to access and use the Services. This license is for the sole purpose of letting you use and enjoy the Services' benefits as intended by Game Guru and permitted by this Agreement. You agree not to:

  • Use the Service or any content contained in the Service for any commercial purposes without our written consent
  • Copy, modify, publish, create any derivative works from, make use of, or reproduce in any way any copyrighted material, images, trademarks, trade names, service marks, or other intellectual property, content or proprietary information accessible through the Service without Game Guru's prior written consent
  • Express or imply or claim that any statements you make are endorsed by Game Guru
  • Use any robot, bot, spider, crawler, scraper, site search/retrieval application, proxy or other manual or automatic device, method or process to access, retrieve, index, "data mine," or in any way reproduce or circumvent the navigational structure or presentation of the Service or its contents
  • Use the Services in any way that could interfere with, disrupt or negatively affect the Service or the servers or networks connected to the Service
  • Upload viruses or other malicious code or otherwise compromise the security of the Services
  • Forge headers or otherwise manipulate identifiers in order to disguise the origin of any information transmitted to or through the Service
  • "frame" or "mirror" any part of the Service without Game Guru's prior written authorisation
  • Use meta tags or code or other devices containing any reference to Game Guru or the Service (or any trademark, trade name, service mark, logo or slogan of Game Guru) to direct any person to any other website for any purpose
  • Modify, adapt, sublicense, translate, sell, reverse engineer, decipher, decompile or otherwise disassemble any portion of the Service, or cause others to do so
  • Use or develop any third-party applications that interact with the Services or other Users' Content or information without our written consent
  • Use, access, or publish Game Guru's application programming interface without our written consent
  • Probe, scan or test the potential vulnerability of our Services or any system or network
  • Encourage or promote any activity that violates this Agreement publicly or privately

The Company may investigate and take any available legal action in response to illegal and/or unauthorised uses of the Service, including termination of your account.

Any software that we provide you may automatically download and install upgrades, updates, or other new features. You may be able to adjust these automatic downloads through your device's settings.

13. Rights You Grant Game Guru

By creating an account, you grant Game Guru a transferable, worldwide, sub-licensable, royalty-free, right and license to host, store, use, copy, display, reproduce, adapt, edit, publish, modify and distribute information you authorise us to access from your Game Guru account information as well as any information you post, upload, display or otherwise make available (collectively, "post") on the Service or transmit to other Users (collectively, "Content").

Our license to your Content is subject to your rights under applicable law (for example laws regarding personal data protection and UK GDPR to the extent any Content contains personal information as defined by those laws) and is for the limited purpose of operating, developing, providing, and improving the Service and researching and developing new ones.

You agree that all information that you submit upon creation of your account is accurate and truthful and you have the right to post the Content on the Service and grant the license to Game Guru above.

You understand and agree that we may monitor or review any Content you post as part of a Service. We may delete any Content, in whole or in part, that in our sole judgment violates this Agreement or may harm the reputation of the Service.

When communicating with our customer care representatives, you agree to be respectful and kind. If we feel that your behaviour towards any of our customer care representatives or other employees is at any time threatening or offensive, we reserve the right to immediately terminate your account without refund.

In consideration for Game Guru allowing you to use the Services, you agree that we, our affiliates, and our third-party partners may place advertising on the Services.

You agree that Game Guru may access, preserve and disclose your account information and Content if required to do so by law or in a good faith belief that such access, preservation or disclosure is reasonably necessary, such as to: (i) comply with legal process; (ii) enforce this Agreement; (iii) respond to claims that any Content violates the rights of third parties; (iv) respond to your requests for customer service; or (v) protect the rights, property or personal safety of the Company or any other person.

14. Game Guru Community Rules

By using the Services provided by Game Guru you agree that you will not:

  • Use the Service for any illegal activity or activity prohibited by this Agreement
  • Spam, solicit money from, extort or defraud any Users
  • Impersonate any person or entity
  • Bully, "stalk", intimidate, harass or defame any person
  • Post any Content that violates or infringes anyone's rights, including rights of publicity, privacy, copyright, trademark or other intellectual property or content right
  • Post any Content that promotes racism, bigotry, hatred or physical harm of any kind against any group, society, community or individual
  • Post any Content that is hate speech, threatening, sexually explicit or pornographic; incites violence; or contains nudity or graphic or gratuitous violence
  • Post any Content that supports or promotes terrorism or organisations/individuals involved with terrorism in any shape or form
  • Solicit passwords for any purpose, or personal identifying information for commercial or unlawful purposes from other Users or disseminate another person's personal information without his or her permission
  • Use another User's account
  • Create another account if we have already terminated your account, unless you have our permission

Game Guru has the right to analyse your account and delete your content or terminate your account without refund of any purchases if it violates the terms outlined in this Agreement. Termination is justified if you misuse the Service or behave in any way that Game Guru deems to be unlawful, including actions or communications that occur off the Service but involve Users you interact with on the Service or at the venue.

15. Other Users' Content

Game Guru reserves the right to analyse and delete Content that violates the terms of this Agreement. Such Content is the personal and sole responsibility of the User that generates it. As a result Game Guru cannot guarantee that all Content will comply with this Agreement. If you see Content that violates the terms and conditions of this Agreement, please report it within the Services or via our customer service team.

16. Notice and Procedure for Making Claims of Copyright Infringement

Content that has been copied and posted on the Service may infringe copyright laws. If your Content has been used without authorisation, please contact our customer service team with the following information:

  • An electronic or physical signature of the person authorised to act on behalf of the owner of the copyright interest
  • A description of the copyrighted work that you claim has been infringed
  • A description of where the material that you claim is infringing is located on the Service (and such description must be reasonably sufficient to enable us to find the alleged infringing material)
  • Your contact information, including address, telephone number and email address
  • A written statement by you that you have a good faith belief that the disputed use is not authorised by the copyright owner, its agent, or the law
  • A statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorised to act on the copyright owner's behalf

17. Retail Sales and Collectables

17.1 Product Availability

Products shown on the Service or available at the venue are subject to availability. Game Guru does not guarantee that any specific product will be in stock.

17.2 Product Descriptions

While we strive to ensure product descriptions and images are accurate, we do not warrant that product descriptions, images, or other content is complete, accurate, reliable, or error-free.

17.3 Returns and Exchanges

Returns and exchanges on retail purchases are subject to Game Guru's retail returns policy, which will be provided at the time of purchase.
Due to the nature of some items, we are unable to offer refunds or exchanges. Please choose carefully before purchasing. This does not affect your statutory rights. This product policy applies to: Video Games, Nintendo Switches, Consoles, Collectibles, Trading Cards.

18. Disclaimers

Game Guru offers the Service on an "as is" and "as provided" basis and to the extent available by applicable law, grants no warranties of any kind, whether expressed, implied, statutory or otherwise with respect to the Service (including all content), including, without limitation, any implied warranties of satisfactory quality, merchantability, fitness for a particular purpose or non-infringement.

Game Guru does not represent or warrant that the Service will be uninterrupted, secure or error free, that errors in the Service will be mended, or that content or information you receive through the Service will be accurate.

Game Guru takes no responsibility for any content that you or another third party posts, sends or receives through the Service. Any content you receive through the Service is viewed at your own discretion and risk.

Game Guru does not guarantee the safety, quality, or condition of games, equipment, food, or beverages, beyond what is required by law. We are not liable for any illness, injury, or loss that may occur at the venue except where caused by our negligence.

19. Third Party Services

This Service may contain advertisements and promotions offered by third parties including links that can be used to navigate to other websites or services. Game Guru does not take any responsibility for the availability or lack thereof of such external content or resources. If Users interact with third parties they do so at their own risk and the User is then governed by the terms provided by the third party. Game Guru is not liable or responsible for any User's interaction with third parties or for such third parties' terms or actions.

20. Limitations of Liability

To the fullest extent permitted by law, in no circumstance will Game Guru, its affiliates, staff, employees, directors, licensors or service providers be liable for any indirect, exemplary, consequential, incidental, special or punitive damages, including, without limitation, loss of revenue and profits, whether incurred directly or indirectly, or any loss of data, or other intangible losses, resulting from: (i) your access or use of the Service (ii) your inability to access or use the Service (iii) the conduct of any third party on the Service (iv) unauthorised access to or alteration of your content (v) any food, beverage, or product purchased through or at Game Guru (vi) any injury, loss, or damage occurring at the venue except where caused by our negligence

In no circumstance will Game Guru's aggregate liability to you for all claims relating to the Service exceed the amount paid by you to Game Guru for the Service in the 12 months preceding the claim.

Nothing in these Terms & Conditions excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by English law.

21. Jurisdiction

All claims will be governed by English law and will be litigated exclusively in the Courts of England and Wales, and you and Game Guru consent to personal jurisdiction in these courts.

22. Indemnity by You

You hereby agree, to the extent permitted under applicable law, to indemnify, defend and hold harmless Game Guru, our affiliates, and their and our respective officers, directors, agents, and employees from and against any and all demands, complaints, claims, damages, losses, costs, liabilities and expenses, including attorney's fees, due to, arising out of, or relating in any way to your creation of a Game Guru account, your use of the Service, your conduct at the venue, or your breach of this Agreement.

23. General Provisions

23.1 Entire Agreement

This Agreement, together with the Privacy Policy, contains the entire agreement between you and Game Guru regarding the use of the Service.

23.2 Severability

If any provision of this Agreement is found to be unenforceable, the remaining provisions will continue in full force and effect.

23.3 No Waiver

The failure of Game Guru to enforce any right or provision of this Agreement will not be deemed a waiver of such right or provision.

23.4 Assignment

You may not assign or transfer this Agreement or your account to any third party. Game Guru may assign this Agreement without restriction.

23.5 Force Majeure

Game Guru shall not be liable for any failure to perform its obligations under this Agreement where such failure results from circumstances beyond our reasonable control, including but not limited to acts of God, pandemic, fire, flood, strikes, or governmental restrictions.
